Can NRIs buy land in West Champaran?

Yes. Indian citizens with NRI status can freely buy residential, commercial, and agricultural land in India (with the exception of certain border areas — Sikta and Mainatanr have additional clearance requirements due to proximity to Nepal). Persons of Indian Origin (PIO) and Overseas Citizens of India (OCI) can buy non-agricultural land.

Step 1: Decide your buying mode

You have three options:

  • Travel and sign personally. Cleanest, but requires 5–7 days in India.
  • Power of Attorney to a trusted family member. Most common. The PoA must be notarised at the Indian Embassy/Consulate in your country, then apostilled, then registered in Bihar within 90 days.
  • Power of Attorney to your real estate firm. We do this for Champaran Bhumi clients regularly. We act in your name, attend the sub-registrar, and ship original documents to you.

Step 2: Money transfer

Funds must come through proper banking channels:

  • NRE (Non-Resident External) account — fully repatriable
  • NRO (Non-Resident Ordinary) account — for India-earned income
  • FCNR (Foreign Currency Non-Resident) account — for foreign currency holdings

You cannot bring cash exceeding US$5,000 equivalent without declaration. Payment must be via NEFT/RTGS/wire from one of the above accounts. Save every transaction reference — it will be referenced in your sale deed.

Step 3: KYC and PAN

You need:

  • Indian PAN card (apply at NSDL website if you don't have one — takes 2–3 weeks)
  • Indian passport copy with valid visa stamp showing NRI status
  • Proof of overseas address
  • Most recent visa or work permit

Step 4: TDS and tax

If you ever sell the property, the buyer must deduct TDS at 20% (long-term) or 30% (short-term) of capital gains. Plan for this in your exit strategy.

Step 5: Due diligence — extra strict for NRIs

NRI buyers are sometimes targeted by inflated pricing or weak titles. We strongly recommend:

  • Video walkthrough of the property by a trusted family member
  • Independent title verification (we recommend a Bettiah-based lawyer separate from the seller's)
  • Two physical inspections before payment
  • Bank-routed payment in milestones, not lump-sum upfront
